It's Only Rape if She Screams at Portola Middle School in El Cerrito, California


At this rate, my long anticipated public unveiling of Tavis Smiley's sycophants might get pushed back to Christmas week, but the hits just keep on coming. I initially read about this story, but didn't post it, but that becomes almost impossible because irrespective of whether or not a 12 year old girl was raped in a stairwell by another 14 year-old student.

The legal system will do what it will, but the attitudes related to sexual violence by the administrators ranks right up there at the top of the WhatTheHeckWereTheyThinking scale of idiocy. Mother Jones has a collection of responses from school staff and administrators, but these two from the school supervisor and assistant supervisor stood out:
School site supervisor Marquita Dones: "If she was being raped, why didn't she scream? Why did these students have to come up and tell us that somebody's down there?"

Cannon again: "I know the girl and I know the guy... I know for a fact that that girl could've knocked that guy out with one hand tied behind her back." Mother Jones

Oh really? Mr. Cannon are you saying she was as strong as an ox? Are you saying she was "unrapeable"? She was 12, the alleged assailant is 14. No difference in muscle mass and strength?

Here is the LAW you idiot school administrators:
Juvenile prosecutor Dan Cabral: "A child under the age of 14 cannot be touched... Regardless of consent or not, no person in the State of California is allowed to touch a child under the age of 14 for purposes of sexual gratification."

Tavis Smiley probably already has these folks on the line to give them his Black Girls Are Unrapeable Book Deals.

Lord knows I want to keep my daughter locked up at home for her own safety but can't. The best I can do is arm her with knowledge so she can defend herself best she can in this world. Look at the attitudes, the disregard for our daughters. What if its their daughters? What about our daughters?

Okay,

I finished watching the video and I am thorughly disgusted. The school is in a deistrict not too far from the School where a teenage girl had been beaten and gangraped outsied of her high school dance.

Watched the video and the so-called site supervisors are just covering their rusty-dusties. They are all worried about covering up the obvious lack of security at this school at the expense of this little girl. They would rather put a young rapists back in the school (which also keeps him from possibly getting some mental help) than admit that there is a problem and that they fell down on the job.

Ridiculous...Has to be some of the most obtuse people walking the earth...I REMEMBER being 12...I did not even want a male DR to examine me...Would have been mortified to have people see me with my skirt up even though I was being violated...And ummm...Could she have been in shock???

El Cerrito is right near Richmond, the city where that high school girl was gang raped after a homecoming dance. Why interview this guy if he doesn't even know what happened?

the truth is none of us know what happened. we do know that the comments by the Site Supervisors are ludacris. neither of these site supervisors returned to work the following day- and I doubt by choice. there is a need for education- on all levels: the youth, the community, education staff. I work with Portola Middle School students. Ultimately, Site supervision has failed, but we must remember rape, sexual assault is a much bigger issue that needs to be addressed beyond pointing blame. What I mean is, our societal norms and behaviors contribute to a culture that in some ways fosters sexual abuse. I am a survivor and I see it everyday.

You nailed it on the head. Citing the Richmond gang rape as an example, commentator Mark Earley (Prison Fellowship Ministries) further expands upon your point. An excerpt:

Many people live in dangerous neighborhoods where “snitching” is dangerous, but they don’t gather to watch another person being brutalized, much less take photos or laugh. After all, the attack ended when people down the street from the school learned what was happening and called the police.

The response that shocked the nation speaks to an indifference to the well-being of others among some of our children. Instead of empathy, these young people showed apathy—and, as one observer said, “a total indifference to [behavior], customs, mores, and sensibilities,” the things we associate with being civilized.

What happened in Richmond, California, is an unsettling reminder that the standards that make a good society possible cannot be taken for granted. It doesn’t take much to set them aside. That’s why those standards and the beliefs that make them possible must be taught and renewed continuously.

As one Oakland pastor wrote, what happened on October 23rd “is reflective of a societal breakdown that is not limited to the Richmond city limits.”

That's true, but according to California law, unless the perpetrator is more than 3 years older than the victim, the crime is a misdemeanor (if the victim was a willing participant).
