Genarlow Wilson Released- How Long Til' He Starts Posting on MYSPACE?

Georgia's State Supreme Court has ruled that Genarlow Wilson's 10-year sentence for having consensual oral sex when he was a teenager is "cruel and unusual punishment" and ordered him freed. SOURCE
Chief Justice Leah Ward Sears wrote in the majority opinion that the changes in the law "represent a seismic shift in the legislature's view of the gravity of oral sex between two willing teenage participants."
Sears wrote that the severe punishment makes "no measurable contribution to acceptable goals of punishment" and that Wilson's crime did not rise to the "level of adults who prey on children." SOURCE

While I agree that the antiquated state law was written in language that shouldn't include teens having consensual sex, I had little sympathy for Wilson's case. What his supporters don't tell you is that Wilson was offered the same plea deal as the other boys at the party who also had consensual sex with the underage teen. His co-defendants took the deal but Wilson refused - preferring to take on the mostly white and very racist Georgia judicial system.DITTO!
While he languished in jail - for making more than one poor decision - his co-defendants did their little time and were released. The thing to remember is that a law was broken whether it's a fair law or not. Wilson's attorney should have explained that the law won't change overnight and she should have urged him to accept the plea deal. Sometimes people make bad decisions on their own and they have to suffer the consequences.

Praise the Lord. I hope young Genarlow will walk a fine line down there in that racist confederate state. If I were his mom, we'd be on the next thing smoking out of Georgia; go somewhere else and start a new life, get him into college, encourage him to mentor some young black males or something. But I'd get outta Georgia for a while.
I need the legal reason why you can go back and say "the law is bad and we didnt mean for it to punish teens having sex with each other" but you cant change the convictions that were a result of the (what the legislature called) a bad law.
Common sense says you should but common sense and what we deem "the right thing" does't always walk hand in hand with the law.

I was just listening to WOL AM in Atlanta. And people are calling in to say how happy they are he's out. One caller suggested that a fund should be set up to help him go to college.
My question is, what about the girl? who is gonna set up a fund for her? Is anybody thinking about the victim? Has anybody offered her counseling?
It seems that 14 year old Black girls just get lost in the shuffle. RKelly's (alleged) victim sure can't get any justice (seven years after the fact).
The legal reason is laws aren't typically retroactive, unless of course the legislature decides to make it so. In this case they clearly didn't because they didn't want to deal with the political consequences of having to release dozens if not hundreds of sex offenders.

Wilson needs a college fund, the kid just got out of jail, and should never had been there in the first place, he has to rebuild his life.
The 15 year old girl, the17 year old girl AND Genarlow were all stupid for one, getting drunk, two, having sex as teenagers. Stupid yes, but it happens all the times, because ADULTS fail. And even with the BEST Parenting in the world, guess what, KIDS, will STILL do Stupid things.
The 15 year old girl was probably more traumatized by the fact that her actions with Genarlow are now public record. What we should have is ADULTS, in schools, in Church, or wherever teaching kids (MALE AND FEMALE) to respect themselves and not have sex early in life.
Should the 15 year old girl get a college fund, sure, I have no problem with that. But her bad decision didn’t land her in jail with felons. She may need counseling and hopefully has learned to respect herself and her own body a bit more through all of this.
Generalow has NOTHING in common with R. Kelly, a grown arse man that pissed on a child. Comparisons are far overreaching with that.
The girl involved is in the military now. Her mother was interviewed by the AJC a few months ago and said her daughter did not want to see Genarlow or the other young men prosecuted from the very beginning.
There were TWO girls. The 17 year old has been consistent in saying that she was gang raped. The video supports that she was A) drunk or B) completely passed out.
of coure the 15 year old would say she didn't want him prosecuted. thats why we have statutory rape laws because 15 year olds are stupid.

15 year olds used to be called 'jailbait' for a reason. Due to their immature development, they should not be encouraged to get sexual with boys or men. If he impregnated the girl, or gave her HIV, would you still want to set up scholarship fund for him?
We need to STOP the open season on young girls. Our daughters are not here to be 'pimped' and used by grown men or underaged boys. They are to be loved, protected and respected. This was NOT some Romeo and Juliet scenario. It was disgusting and degrading exploitation.

O.K., Underage Boys and Underage girls have sex OFTEN. That is a reality, and sorry, I don't think they need to be in jail for 10 years because they do.
Underage Girls having sex with grown arse men is quite a different issue.
We need to teach by example to our Young men and women to respect each other AND themselves.
Simple as that. If we taught young girls that they have more value than their bottoms and breast, and if we taught young men that women are more than their bottoms and breast, THAT might cause some change that would follow them into adult hood.
I believe we need to protect our young sisters, but not by throwing away young brothers to the penal system.

What I am trying to say is that video shows an exploitive orgy, not two young innocent kids exploring their sexuality. One girl was clearly unconscious during part of it.
I don't care how often teenagers have sex. It's not OK to have a videotaped orgy including a 15 year old, PERIOD.
I will NEVER advocate clearing a legal pathway for a drunk 15 year old to be placed in a hotel room to be sexually pimped by guys of any age.
Genarlow knew that it was illegal to be with that girl. Like many boys his age, he believed that he was above the law, and that nobody would give a damn about 'some silly black girl.'
Wilson got 10 years for REFUSING A PLEA -- not for having some love affair with a girl. The plea would have given him an appropriate judgement. He was NEVER 'innocent'.
Genarlow claimed that he was 'standing up for what is right', meaning that there should be no legal protection for 15 year old girls from sexual exploitation -- at least not from the army of boys who are increasingly seeing black girls as worthless, dehumanized sex-delivery vehicles to be used, impregnated, scorned, and discarded.
From what I saw, this Genarlow case was not mutual pleasuring... for lack of a better word. The underage girl was a mule for his own selfish sexual gratification.
Where is the call for a scholarship fund for all the black boys who respect themselves and black girls, who are doing something positive in life? What is all of this 'support' of BBBB's (black boys behaving badly) teaching moral black boys?

17 and 15 is hardly statutory rape territory. ESPECIALLY if he would have had intercourse with her and none of this would be the case.

There's MAJOR hypocrisy in that.
There is a MAJOR conversation that needs to be had with young men about sex, women, and right and wrong.
Just because someone allows you to use them doesn't mean you should.
And young girls need to be taught an love and appreciation for self and their bodies. And recognize they have an identity outside of what a Male wants from them.
But Wilson is hardly a walking tyrant. He's a young man that did what too many young men do and if ADULTS would take more responsibility for what we teach youth-instead of encouraging that behavior, teach young men there are other ways to be a 'man' and it's not solely based on how many women you can bag.
I think the plea would have been accurate. And he should have thought about how he was jeopardizing his relationship with his little sister when he was booking the hotel room and setting up the video camera.
When Genarlow's sister is 15 years old, and some 17 year old boy decide to gloat with his friends over a videotape himself being 'serviced' by that little sister, he will understand better why people like me don't like him.

The message Georgia sent with the original law is, It's perfectly okay to have intercourse with 15 year olds if you're 17 but DON'T have oral sex.

Yes, having sex with an unconsious woman makes you a sex offender. Having sex with a minor makes you a sex offender.

Now I agree with you, however:
1. 15 years old and DRUNK shouldn't even be in the same sentance;
2. From what I gather: Here are the facts:

Truly a messed up situation. Should they have been videotaping any of this? Nope. Should they have been drinking underage? Nope. Should 15 year old and 17 year old girls get pissy drunk and either go to a room with a bunch of guys or get drunk in a room with a bunch of guys? Nope. Should ANY male have sex with a drunk female? Nope.
Fact is, it was a horrible situation, everybody there made BAD CHOICES. But did ANYONE deserve 10 years? In my opinion (and in the opinion of the Georgia High Court) No.
Here is the great sociological reality: Young girl often want young boys to like them, so they do what they THINK they should based on some very seriously screwed up perceptions of Black womanhood, these guys often are falling in line with what they THINK they are supposed to be doing, chalk it up with this damn distorted gangsta / pimp image of black maleness that is being pushed out there, further, when they see women getting treated like all they are good for is their bottoms and breast, then that is the mindset they develop.
Fact is, I don't expect teenage boys or teenage girls to do well IF WE AS ADULTS continue to allow these images to dominate what they see being a Black man or a Black woman is. I think that it is wrong to put the onus on Black boys or girls, they are kids, and kids do dumb things.
This isn't a male vs. female issue; ADULT BLACK MALES & FEMALES have to create a better environment and help establish a better MINDSET.

Nobody threw Gencarlow under a bus. He like so many young black men in this generation think of black women as nothing but pieces of meat. He deserved to go to jail. We need to stop making excuses for young black men who get in trouble and then cry saying they're being unjusticely prosecute. Nobody in the courts is picking random young black men and randomly putting them in jail. They are committing crimes. We as African Americans need to face that fact that we have failed a whole generation.
The 17 year old girl was basically passed out. She charged him with rape, but when it got around school the black students were threatening her. So, she told the DA wouldn't testify. The DA found out about the age of the other girl and decided to take that right. I saw part of the tape. The boy basically date raped those girls. They told the 15 year the wouldn't take her home and call her mother to tell her where she was.

Genarlow was not a BLACK MAN, he was a BLACK BOY. The difference may not mean much to you, but it is the same difference if the 15 year old girl were a 30 year old woman.
Hate men all you want, but he was a CHILD as was the 17 year old girl and the 15 year old girl.

We are mostly on the same page. Just an anectdote: at a local public high school in NJ, they introduced 8th graders to the high school, to save money. One year later, they broke up a prostitution ring of older boys selling the 12 and 13 year old girls to each other for money and marijuana.
These boys are going after younger and younger girls because they feel that they are less likely to get pregnant or have a disease.
Make no mistake... what is going on has nothing to do with normal sexual curiosity, as in days past.
Also, I completely agree that a 15 year old should never be drunk. It also does not make her fair game for rape.

I worked in a center for sexual abused center. More than half were black girls and most were sexually abused by cousins and relatives in fact only a few years older. When the girls told their family member, they were simply told to stop being fast.
That's why the law is on the books to protect young girls. No matter how you look at it, these girls do not have the mental maturity to make these types of decision. Men prey on them, all ages 17-50. Genarlow should have no better than to sexually exploit an under age girl. It's called common sense and deceny. And as my favorite quote from my mama "Just because you are ignorant of the law doesn't make you any less guilty"

I agree, that is why I tell young men I have had the privilege of serving with as a NCO in the Marine Corps, to NEVER have sex with an intoxicated person, WAYYYYY to much to interpret if there is ever a question.
The case record said the 15 year old offered oral sex to Genarlow, and the case record said the 17 was not unconscious but was intoxicated, the jury didn’t buy her rape story, so I hope their finding was accurate.

No, I haven’t seen that tape or “Kels” tape, I can only go off of the court transcripts and record for Genarlow, and with Kels, I have to go with what people have said and the fact that the prosecutor feels that on what he saw he has a case and R. Kelly’s track record with underage girls of course.

Maybe they do, obviously they are indifferent. I feel that Black Leaders need to speak out more for Black Women and Men in black on black crime.

He is 17 not 7. He knew what he was during was morally and criminally wrong. Everyone in Georgia knows the age of consent is 16. Heck, my 14 year daughters knew that from age 11. Well gosh then, she was 15, he could have had vaginal sex with her and he wouldn't have been charged with a Crime. My question is not one of legal age issues, it is the fact thay he was a kid, 7 or 17 doesn't make a differnece here, as in the girl being 5 or 15 didn't.

As I understand it from the state prosecutor making the law change retroactive would impact the cases of about 1000 sex offenders in Georgia. It's been a while since I read his decision, but that's my opinion.
I know that it would've impacted a case with a young man I know who is doing time under the same statute.

For the most part, I believe Black Men and Women are DIRECTLY repsonisble for the enviornemt we have allowed and in some cases contribute to that devalues Black women as "Bottoms and Breast" and the thug / pimpification of Black men into valuing only how many places they can put their penis'.

Gabby, read the transcript regarding how the 17 year old said she was basically held prisoner. If I'm not mistaken, one of the boys were convicted of false imprisonment. 17 year olds do know right for wrong. I never called him a man. In fact, a 'real' man no matter how old would've never treated a woman this way

Good point. So, why are we letting pop culture / media define what a REAL Man is? Especially a "real BLACK man". Case in point(Off topic) The whole celebration around this “Frank Lucas” biopic “American Gangster” (sorry Denzel). Everyone on Black radio / TV, etc. is all excited about this like if Denzel got casted to play Moses in the “10 Commandments Remake”. What they hell is wrong with us?
DJ, I am not letting pop culture define what a good man is we are. We put the wrong black men on a pedestal. I can honestly say we are becoming too blinded by fame, wealth, and materialism. I see good black men everyday, especially in my own family. My concern is we are sending black boys wrong message. I don't think we are holding them accountable for their actions. As a family who has lost few of male members to gun violence and to jail for committing stupid crimes, I really feel our boys don't need our blind faith but our stern hands.

I agree, but what are "we" doing to stop this type of "American Gangster / Belly / Menace to Society / Players Club, etc., etc." from being the predominate image? I have no problem holding our youth accountable (or anyone else), but just as in the Jena 6 situation, we cannot let our children be sentenced excessively. As bad as you think Genarlow Wilson was, giving him 10 years in the penal system would almost guarantee that if you didn't have a monster going on, you would have a real monster coming out. Had the boy got maybe 2 years, counseling and some actually rehab, that’s one thing, but 10 years? Excessive.
We have to hold people accountable, but we cannot allow our children to be thrown away on legal technicalities.

I am just disgusted that some black men just don't get it. The girls in this case are the victims period!!! It doesn't matter about parenting, it doesn't matter about whether teenagers respect themselves or not, it doesn't matter if some teenagers have sex...the law is the law.

Sexual assault is not always brutally violent like a Megan Williams or Dunbar Village case. A large number of sexual assualts occur in circumstances just like the Genarlow Wilson case with significant numbers of the defendants and victims the same ages as Genarlow Wilson and the victims. Date rape is most frequent and the most unreported!!!!
Instead of whining about the justice system, bad parents, and whether being 17 is a man or not, we should be have an open discussion about why the black community STILL continues to FAIL to have open and honest discussion about black on black sexual assault and domestic violence.
And how about this - How about NO scholarship fund for Genarlow Wilson? How about he get a job and pay for it himself? Why do we always want to reward bad behavior? His verdict was not overturned - he was not declared innocent - his sentence was reduced that's all.
There are plenty of black males that are not engaging in sex acts with underage girls and recording it on cellphones who need college funds. As a matter of LAW Tracy, the Supreme Court of Georgia has RULED that this was EXTREME (Cruel and Unusual). Now again, unless Scalia and CO take this up, that is the LAW.
The LAW in Georgia now is that a 17 CAN have oral sex with a 15 year old.
Now if we don't want that to be the actuality, we have to discuss the greater sociological issues and how we can change them.

You are right -- it has now become completely legal for a 15 year old girl to be pimped sexually (I refuse to call what I saw sex, as no one involved was concerned about her welfare), and videotaped having sex -- as long as it's done by a 17 practicing to be a pimp.
Next year, an 18 year old molesting a 15 year old will demand to know why he he is being locked up for what would have been legal for him 6 months ago. And black folks will be up in arms, and raising scholarship money for him.

I meant the Genarlow video, not the R Kelly video. When I saw it, I couldn't sleep that night from the images.
The 17 year old was literally passed out (eyes rolled back/closed, mouth open), and was carried like a sack of potatoes to a bed and raped. She is so disoriented and groggy that I strongly suspect that she was drugged rather than drunk. They had to grab handfuls of her hair to keep her head upright while using her sexually. Her eyes kept rolling back in her head.
I have been told that she refused to testify, which is why the prosecutor went for the max in incident with the 15 year old. I will check on this to see if there is any validity to that part of the story, however.

Well, if what you say is what happened, and based on what I read on another post of this guy referring to the incident as: "Fun" as opposed to a mistake, I just don't know what to say.
I might have to convert BACK to Judaism, so I can start calling myself Jewish when people ask me my ethnicity (I believe I have some Ethiopian Jewish blood on my mother's side, but I really don't go there often, to hard to explain), I am embarrassed for Black Folk right now.
How is it that this kid wasn't charged with real RAPE? If they have on tape this girls eyes rolling back in her head while this abuse is going on this is horrible. I still say for the act of SEX between teens there should be no jail time, but RAPE, assaulting women or girls who are to drunk of high to resist, come on!
Why would the jury let him off of that charge if the evidence is really that damning?

You GROSSLY missed the point!!! If you took about five mintues to stop finding excuses for Genarlow and looked at the victim's point of view then maybe you would have understood my point.
Further, was Genarlow Wilson declared innocent? NO!!!! This is what occurred in his case -
"The high court had turned down Wilson's appeal of his conviction and sentence, but the justices agreed to hear the state's appeal of a judge's decision to reduce Wilson's sentence to 12 months and free him. That judge had called the 10-year sentence a "grave miscarriage of justice."
Dumping or changing the law later, does NOT change the circumstances of his case. I agree his sentence was hard for the crime. And please remember that he was convicted of a crime.
And I noticed how you skipped the portion of my post about understanding what sexual assault is and the failure of the black community to have THAT discussion. If you and other folks in the black community continue the HORRIFIC practice of blaming the victim and making excuses for the one committing the assualt, then black women and girls will still continue to be victims of sexual assault.
